Terms of use

These terms are in force and govern your use of the BORAKA website and platform. Please read them before creating an account or enrolling in a course, program or service.

The structure below is complete, the operating entity is named in section one, and governing law and jurisdiction are set to Maryland. A postal notice address is the one remaining item to confirm.

These terms govern your use of the BORAKA website and the BORAKA platform. By using the website, creating an account, or enrolling in a BORAKA course, program or service, you agree to them. If you do not agree to them, do not use the platform.

BORAKA is operated by YANA Careers, LLC, the legal entity that operates this website and the BORAKA platform. These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Maryland have exclusive jurisdiction over any dispute arising from them.

Legal notices may be sent to YANA Careers, LLC through the contact page on this website, which is our published channel for notices under these terms.

2. Effective date and version

These terms are version 1.0 and take effect on 4 September 2026. They replace any earlier draft published at this address.

We keep the version and effective date at the top of this page current. Where a change materially affects your rights or obligations, we will tell account holders and state the date the change takes effect.

2. Who may use BORAKA

Accounts are for individual professionals and for named staff of organizations that have agreed a scope of work with us. You must be old enough to enter a contract in your jurisdiction, provide accurate registration details, and keep your sign-in credentials to yourself.

Accounts are personal. Sharing an account, or submitting assessed work that is not your own, is a breach of these terms.

3. What BORAKA provides

BORAKA provides learning material, practice simulations, casebooks, structured assessment against published criteria, human review of submitted work, and records of what was demonstrated.

Availability of any individual area of the platform may change. Some areas are in development and are described as such where they appear.

4. What BORAKA is not

BORAKA is not a background-check, employment-verification, education-verification, licensure-verification or accreditation service, and it is not a recruitment agency or an employer.

A BORAKA record states that a person met defined requirements and demonstrated specified capability inside BORAKA, on a stated date, against a stated rubric version. It is not a license, a professional registration, an accreditation, a prediction of job performance, or a guarantee of employment, salary or outcome.

Nothing on the platform is medical, legal, regulatory or employment advice, and nothing on it replaces a study protocol, a standard operating procedure, or the judgment of a qualified professional.

5. Assessment integrity

Preparation, editing and the disclosed use of assistive tools are legitimate. Borrowed identity, fabricated experience, submitting work that is not yours, and undisclosed real-time assistance during an assessed attempt are not.

Where integrity rules are breached we may withhold, withdraw or annotate a record, and we may suspend or close the account. Scored work is reviewed by a person, and a review decision may be appealed through the process described in the final version of this document.

6. Your content and your evidence

You keep ownership of the work you submit. You grant BORAKA the permission it needs to store that work, review it, score it, and produce the resulting record.

You control who sees your evidence outside BORAKA. Sharing is off by default and any share link you create can be revoked by you.

7. Our content

Course material, casebooks, simulations, rubrics, written guidance, imagery, software and the BORAKA brand belong to BORAKA or to its licensors. You may use them for your own learning and assessment. You may not copy, resell, publish, scrape or use them to build a competing product.

8. Payment, access and cancellation

Paid programs, courses and engagements are governed by the order, invoice or statement of work agreed with you, which states price, duration, access period and refund position. Where that document and these terms conflict, that document takes precedence for the paid item.

Where the order document does not state a refund position, this default applies: you may cancel a self-paced course or a one-time service in writing within 14 days of purchase and receive a full refund, provided you have not accessed more than a quarter of the material and no deliverable has yet been produced for you. After that point, or once substantial delivery has begun, fees for the item are non-refundable.

Instructor-led programs and cohort places may be cancelled in writing up to 7 days before the cohort start date for a full refund; after that date the place is charged in full and may be deferred once to the next cohort at our discretion. Recurring memberships may be cancelled at any time before the next renewal, and access continues to the end of the period already paid for.

Refunds are made to the original payment method. Nothing here removes a statutory refund or cancellation right you hold under the law of your own country.

9. Acceptable use

Do not attempt to gain unauthorised access to the platform or to another person's account or evidence, interfere with its operation, upload malicious code, or use the platform unlawfully, abusively or to harass anyone.

AI assistants on the platform are support tools. They make no hiring, medical, legal or regulatory decision, they may be wrong, and their output should be checked before it is acted on.

10. Privacy

How we handle personal data is described in the privacy notice, the data privacy statement and the cookie policy, which are published separately and form part of these terms.

Website use is measured with our own first-party analytics running on our own infrastructure. There is no third-party analytics provider, no advertising identifier and no cross-site tracking, and measurement data is not sold or shared. The cookie policy sets out what is recorded and for how long.

11. Liability and changes

The platform is provided as it is. To the extent the law allows, BORAKA is not liable for indirect or consequential loss, for lost profits, or for hiring, employment, contractual or study decisions taken by you or by a third party.

We may change these terms. Where a change is significant we will tell account holders and state the effective date. Disputes are governed by Maryland law and heard in the Maryland courts named in section one; the limitation of liability above applies to the extent Maryland law allows.
